Global Inheritance Environmental T-Shirt Design Contest No Purchase Necessary 1. Sponsor: Global Inheritance, Inc., 1855 Industrial St,, Suite 613, Los Angeles, CA 90021, who is solely responsible for all aspects of this contest (“Contest”). 2. Description of the Contest: This Contest is a skill promotion in which you are invited to create an original t-shirt design that represents your environmental message. To do so, create and sketch an original color design for the front of a t-shirt, using no more than six (6) colors including the base color, no larger than 10" x 10" and using no photography (“Design”). Designs that are offensive to any person or group, or that contain any words or graphics that are lewd or pornographic, or that are inconsistent with, or disparaging of, Sponsor will be disqualified. 3. Entry: This Contest may be entered in one of two ways during the period commencing at 12:01:00 A.M., August 5, and ending at 6:00:00 P.M., November 10, 2006 (“Term”). For purposes of these Official Rules (“Rules”), all times and dates are Eastern Time.
“Entry” shall mean and refer to each Internet and Mail Entry. 4. Limitations: All Internet Entries must be received by 6:00:00 P.M., November 10, 2006. and all Mail Entries must be postmarked by 6:00:00 P.M., November 10, and received by November 14, 2006. Only three (3) Entries per person are permitted, regardless of method of Entry. In event of a dispute regarding the identity of the person submitting an Internet Entry, the Entry will be deemed to be submitted by the person in whose name the Address is registered. Entries by any method other than set forth above in Section 3 are void. Open only to persons 13 or older upon entering who are legal residents of, and physically located within, the 50 states or D.C. (“Territory”) and not employees of Sponsor or The Walt Disney Company; their respective parent, subsidiary or affiliated companies; or the advertising, promotional or fulfillment agencies of any of them (individually and collectively, “Entities”); nor members of their households or immediate families. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, late, lost, misrouted, non-delivered, stolen, tampered with, unauthorized or unintelligible; or any printing, production, technical, electronic or other errors; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant’s e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations. 5. Ownership of Materials: All Entries must be your original work, must not infringe upon third party rights, nor previously have won awards, nor been published; and you must own the copyright to your Design. If you are declared a Finalist, Sponsor, at its sole discretion, may use your Design to produce and sell t-shirts, without additional compensation to you. 6. Prizes: One (1) Grand Prize: A two (2) day/one (1) night trip for winner and one (1) guest to Aspen, Colorado (“City”) to attend the Winter X Games 11 (“Event”), now scheduled during January, 2007 (“Trip”). The Trip consists of the following elements: [1] hotel accommodations for two (2) (one standard room/double occupancy) for one (1) night; [2] if the winner’s residence is located more than two hundred fifty (250) miles from the City, round-trip coach air transportation for two (2) between the major metropolitan airport nearest to winner’s residence (“Airport of Origin”) and a major airport in or near the City; [3] airport/hotel transfers in City; [4] viewing credentials at the Event and [5] snowboard rental and lift tickets for winner and guest. Approximate retail value (“ARV”): $3,000, which will vary depending upon points of departure and destination and seasonal fluctuation of hotel rates and airfares. Airline carrier and hotel regulations and conditions apply. All expenses not specifically mentioned herein are not included and are solely the winner's responsibility, including but not limited to: round-trip transportation between the winner’s residence and the hotel if winner resides within two hundred fifty (250) miles from the City, round-trip transportation between the winner’s residence and any Airport of Origin, room service, parking fees, laundry service, food, mini-bar charges, merchandise, souvenirs, telephone calls, tips, gratuities and service charges. Travel and lodging are subject to availability, certain restrictions and Sponsor’s approval; and Trip must be taken on Sponsor-selected dates or Grand Prize may be forfeited to an alternate. Two (2) First Prizes: one (1) snowboard, jacket and set of goggles (ARV: $400). Three (3) Second Prizes: one (1) jacket and set of goggles (ARV: $150). Each of the 6 Finalists’ Designs will be displayed at globalinheritance.org from December 5, 2006 through February 20, 2007. Total ARV of all prizes: $4,250. Limit of one (1) prize per person/family/household. Prizes are not redeemable for cash or transferable. No substitution allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. All prizes will be awarded provided a sufficient number of eligible Entries are received and prizes validly claimed by December 15, 2006, after which no alternate winners will be selected, nor unclaimed prizes awarded. 7. Judging: All Entries will be judged by Sponsor’s representatives on or about November 30, 2006, according to the following criteria: communication of environmental message (40%), design (30%) and ability to fuse art with action sports (30%). A numerical score will be calculated using 100 as the highest number. The contestants with the six (6) highest total scores will be declared finalists (“Finalists”). The Finalist with the highest total score will be declared the winner of the Grand Prize and the First and Second Prizes will be awarded to the other Finalists in the order of their scores In the event of a tie, the contestant with the highest score for communication of environmental message and design will be declared a winner. 8. Winners: The potential winners will be notified on or about December 5, 2006, by e-mail and U.S.Mail. All legal responsibilities of a minor under the Rules will be assumed by the parent/legal guardian (“Parent”). Disqualification and the selection of an alternate winner may result from any of the following: [1] potential winner’s failure to respond to notice within seven (7) business days from the date of transmission; [2] the return of an e-mail notification as undeliverable after three (3) attempts; [3] the return of any other notification or any prize as undeliverable; [4] potential Grand Prize winner’s failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within seven (7) business days from the date of transmission; [5] potential Grand Prize winner’s failure to be available to make the Trip on Sponsor-selected dates; [6] potential winner’s failure to validly claim any prize by December 15, 2006; [7] potential winner’s failure to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the Address associated with a winning Internet Entry; [8] potential First or Second Prize winner’s failure to claim any prize within ten (10) days after it is sent and [9] any other non-compliance with Rules. Grand Prize winner and guest must travel together on same itinerary; and any minor must be accompanied on the Trip by his/her Parent, either as the winner or the guest. Guest will be required to execute and return a Release of Liability prior to ticketing. All taxes are solely the responsibility of each winner; and the Grand Prize winner will receive an IRS Form 1099 reflecting the final actual value of the Grand Prize. General Conditions: Each contestant by entering this Contest agrees that: [1] he/she will abide by and be bound by the Rules and Sponsor’s decisions; [2] the Entry will not be acknowledged or returned; [3] he/she hereby irrevocably assigns and transfers to Sponsor and its assigns all rights, title and interest in the Desing, including without limitation all copyrights, and agrees to sign all documents necessary to effect such transfer; [4] he/she hereby grants to Sponsor and its assigns the right to publish, use, adapt, edit and/or modify such Design in any way and in any and all media, without limitation, and without consideration to contestant; [5] the Releasees are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in this Contest or in any activity or travel related thereto or from interaction with, or downloading of, computer Contest information; [6] winner’s acceptance of any prize constitutes the grant of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [7] in the event of viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism, or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Contest, so that it cannot be conducted as originally planned, the Sponsor has the right to cancel, terminate or suspend the Contest; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable, and in the event the Trip has already commenced, to terminate the Trip and return the Grand Prize winner and guest to any Airport of Origin as soon as reasonably possible; [8] the Releasees are not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [9] any portion of any prize not accepted or used by any winner will be forfeited; [10] the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; [11] Sponsor has the right to disqualify any individual found to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or the Website; (b) violating the Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Contest property or service or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; [12] Sponsor has the right to lock out a contestant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Contest; [13] since any attempt by a contestant to deliberately alter or damage the Website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, Sponsor shall have the right to seek damages from any such contestant to the fullest extent permitted by law; [14] the Releasees are not responsible for the cancellation of the Event, or a change of location or date for the Event, and if this happens, the Trip will be awarded without the Event-related prizing elements; [15] any dispute that arises regarding the meaning or interpretation of the Rules shall be resolved by applying the laws of California, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts located within that state and [16] the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). |
